Bombay High Court Approves Herbal Hookah Bar | Warning to Maharashtra Police

 

In a significant decision, the Bombay High Court has given a green signal to the operation of herbal hookah bars in Maharashtra, marking a crucial distinction between tobacco-based hookahs and herbal ones. The court clarified that herbal hookah, which contains no tobacco or nicotine, cannot be considered under the purview of the Cigarettes and Other Tobacco Products Act (COTPA), 2003. This ruling comes after several raids and actions by the Maharashtra Police on various hookah parlors across the state.

The division bench strongly emphasized that the police cannot misuse their authority by targeting legally operated herbal hookah establishments. The court also issued a stern warning to Maharashtra Police, stating that any unnecessary interference or illegal raids on such premises would be considered contempt of court. This directive ensures that genuine businesses serving herbal hookahs can operate without fear of harassment.

According to the judgment, the herbal hookah products being used in these parlors are made from natural and non-tobacco ingredients like herbs, molasses, and fruit extracts. Since these do not fall under the tobacco category, the COTPA restrictions cannot apply. The court highlighted the importance of distinguishing between harmful tobacco substances and herbal alternatives that are legally permissible.

Entrepreneurs and café owners have welcomed the verdict, stating that the decision protects their right to conduct legitimate business and safeguards the livelihood of thousands of workers associated with the hookah industry. Many owners pointed out that previous police actions had caused unnecessary losses, despite following all required health and safety standards.

The Bombay High Court’s decision is being seen as a balanced move, encouraging lawful business operations while maintaining public health standards. However, the court also made it clear that any establishment using tobacco-based hookah under the guise of herbal products would face strict legal consequences.

This ruling sends a clear message: law enforcement must act within the legal framework, and genuine herbal hookah bars have the right to operate without undue interference.
